TERMS OF USE OF THE AU TACOS WEBSITE
1. INTRODUCTION
WE INVITE YOU TO CAREFULLY READ THE TERMS OF USE OF THE AU TACOS WEBSITE.
TO ACCESS THE ONLINE ORDERING SERVICE OF THE AU TACOS WEBSITE, YOU MUST FIRST CREATE AN ACCOUNT BY COMPLETING YOUR CUSTOMER PROFILE AND SUBMITTING TO THESE TERMS OF USE AND TO THE AU TACOS PRIVACY POLICY.
YOUR USE OF THE ONLINE ORDERING SERVICE OF THE AU TACOS WEBSITE CONFIRMS YOUR ACCEPTANCE OF THESE TERMS.
2. PROCEDURE
To access the AU TACOS online ordering service, you must first enter your user ID and your password.
You must be an adult and a resident of Québec. You must also provide all the information that may be requested by AU TACOS to process your order adequately and quickly.
You are responsible for any false or erroneous information you transmit to AU TACOS . You release AU TACOS and its directors, officers, employees, representatives and/or partners from all liability in case of any inadequate, fraudulent or inappropriate use of said site.
3. PRICES AND PAYMENT
The prices are in Canadian dollars (CAD) and are subject to change without notice. The prices indicated on the AU TACOS website are valid only at the time of the order, unless an AU TACOS promotion or advertisement indicates a special price during a specific time period.
By ordering online via the AU TACOS website, you accept to pay the price indicated for your order plus the applicable taxes and any other incidental charges, as applicable, via one of the payment modes offered by AU TACOS. In accepting to pay the total price of your order, you irrevocably authorize any debit/credit card issuer to debit the card used for payment of the price of your order.
4. RETURN & REFUND
Returns and/or refunds on orders are not accepted unless they are due to our mistake.
Returns and/or refunds due to exceeding the order preparation time are not accepted.
5. AUTHORIZATION TO CONTACT YOU
By opening an account to use the AU TACOS online ordering service, you authorize AU TACOS to send you, from time to time, by mail or online, advertising regarding its goods and services, promotional offers, surveys, contests and/or newsletters. If you no longer wish to receive such offers or documents, you may notify AU TACOS in writing in the manner indicated in article 11 below.
6. ERRONEOUS INFORMATION
You are responsible for any erroneous or inaccurate information transmitted to AU TACOS . It is your responsibility to correct, without delay, any error discovered in your profile or your order. AU TACOS obviously is not responsible for the consequences of such a situation or circumstance.
7. COMPLAINT AND COMMENTS
You are invited to communicate with AU TACOS in the manner indicated in article 11 below for any complaint or comments, whether it is regarding a past order, the website, or goods and services. Please be assured that AU TACOS will take your comments seriously and act on them diligently.
8. AVAILABILITY OF GOODS AND DELIVERY
The menus and goods advertised on the AU TACOS website or in its promotions are subject to change without notice.
AU TACOS does not offer delivery service at this time. Only take-out counters service is currently available. The order preparation time is usually about 30 minutes but it can vary depending on the orders and our resources and can not be guaranteed at any time.
9. TRADEMARKS AND RESTRICTIONS ON USE
The name AU TACOS, the registered trademarks, the logos, the slogans and the colours and design of its website are the exclusive property of AU TACOS.
Your right to use the AU TACOS website and its online ordering service is strictly limited to studying our goods, services and promotions and placing orders via our online ordering service.
You may not copy, reproduce, transmit or distribute the contents of the AU TACOS website in any manner, in whole or in part.
Any user of the online ordering section of the AU TACOS website must be an adult and reside in Québec. The user furthermore certifies that the information mentioned in his/her Profile is true and that he/she will not make illegal or inappropriate use of the AU TACOS website.
10. LIMITATION OF LIABILITY AND APPLICABLE LAWS
The data, mentions, indications and information appearing on the AU TACOS website are only indicative. AU TACOS makes no guarantee of any nature whatsoever to the user regarding its website or its contents.
The user further acknowledges that he/she has not been given any promise or warranty to invite or induce him/her to use the transactional segment of the AU TACOS website.
AU TACOS also does not warrant that you will always be able to have access to the transactional segment of its website or that it will always work continuously or that it will always be free of failure.
AU TACOS warrants that the goods and dishes sold via the online ordering service are of merchantable quality. In the event that a customer is not satisfied with his/her order or the use of the AU TACOS online ordering service, that customer should contact AU TACOS by one of the means indicated in article 11 below. In any case, it is expressly understood that AU TACOS’s liability will be strictly limited to the price of the order placed by the customer (excluding taxes) and that it may never exceed this amount.
AU TACOS’s Privacy Policy and these Terms of Use of the AU TACOS website are governed by the laws applicable in Québec.
11. CLOSING YOUR ACCOUNT
At any time, you may close your account by using the function provided for this purpose, which is found in the Customer Profile. Disabling your account will prevent you from placing new orders. To access this service again, you will have to create a new account.
